1. General information and seller identification

These general terms and conditions ("Terms") govern the use of aafit.ro and aafit.eu ("the Site") and the contractual relationship between you, as a customer, and the seller. The AAFIT online store is owned and operated by:

AWA FLOT S.R.L. is referred to as "the Seller", "AAFIT" or "we". This document complies with Romanian Law 365/2002 on e-commerce, GEO 34/2014 on consumer rights and other applicable law.

3. Object and acceptance of the Terms

By accessing the Site, creating an account and/or placing an order, you confirm you have read, understood and fully accept these Terms, which constitute a distance contract under GEO 34/2014. If you disagree, please do not use the Site. The Terms are supplemented by the Privacy Policy, Cookie Policy, Shipping Policy and Return Policy, which form an integral part of this agreement.

4. Capacity to contract

The Site is intended for persons aged at least 18 with full legal capacity. By placing an order you declare that you meet these conditions. Persons under 18 may use the Site only with a parent/legal guardian's consent.

5. User account

You may create an account with accurate, complete data, or sign in with Google. You are responsible for keeping your credentials confidential and for all activity under your account; notify us at comenzi@aafit.ro of any unauthorised use. We may suspend accounts with false information or used unlawfully. You may request account deletion at any time, without affecting ongoing orders or our legal archiving obligations.

6. Products and availability

Products come with informative descriptions and images. We strive to render colours and details faithfully; minor shade differences due to your screen are not a non-conformity. Products are sold subject to stock. If an ordered product is no longer available, we inform you and offer an alternative or a refund within 14 days.

7. Order process and conclusion of the contract

You place an order by adding products to the cart, completing checkout, providing delivery/billing data and confirming via the button implying a payment obligation. After ordering you receive an order-received e-mail which is informative only and does not constitute acceptance. The contract is concluded upon our shipping confirmation. We may decline or cancel an order (refunding any amounts paid) for reasons such as incorrect data, refused payment, out-of-stock, obvious pricing errors or suspected fraud.

8. Prices and VAT

Prices are shown in RON and, where applicable, EUR/USD/GBP, set manually per currency (no automatic conversion). All prices include VAT under Law 227/2015. Prices exclude delivery costs, shown separately before checkout. For discounted products, per Law 148/2023 (Omnibus Directive), we display the lowest price of the previous 30 days next to the reduced price. We may correct obvious pricing errors, cancelling the order and refunding any amounts.

10. Delivery

Delivery is via GLS courier. Timelines, costs and coverage are detailed in the Shipping Policy, an integral part of these Terms. Risk of loss or damage passes to the Buyer when they (or a designated third party other than the carrier) take physical possession of the products.

11. Right of withdrawal (14-day return)

As a Consumer you may withdraw from the contract, without justification or penalty, within 14 calendar days of receiving the products, under GEO 34/2014. Conditions, exceptions (sealed hygiene items/swimwear) and the procedure are detailed in the Return Policy. We refund your payments, including standard delivery, within 14 days of notification, and may withhold the refund until we receive the returned goods.

12. Legal guarantee of conformity

All products carry a 2-year legal guarantee of conformity under GEO 140/2021 (implementing Directive (EU) 2019/771, replacing Law 449/2003) and GO 21/1992. Any non-conformity appearing within 1 year of delivery is presumed to have existed at delivery. You are entitled to repair or replacement and, secondarily, to a price reduction or refund, at no cost. 13. Intellectual property

All Site content (logos, trademarks, the "AAFIT" name, texts, photos, graphics, design, software) is the property of AWA FLOT S.R.L. or its partners, protected by Law 8/1996. Personal, non-commercial viewing is permitted. Copying, reproducing, distributing or exploiting the content without our written consent is prohibited.

14. Reviews and user-generated content

By posting a review you warrant it is yours, genuine and does not infringe third-party rights, and you grant AAFIT the right to use and display it. Per Law 148/2023, we publish reviews only from people who actually purchased the product. We may moderate or remove unlawful, offensive content or content containing third parties' personal data.

15. User obligations

You agree to use the Site in good faith and lawfully. Prohibited: false information, fraudulent orders, unauthorised access, bots/scraping, malicious code and IP infringement. Breach may lead to access restriction, account suspension and legal liability.

16. Limitation of liability

We make reasonable efforts to keep information accurate but do not guarantee uninterrupted, error-free operation. To the extent permitted by law, we are not liable for typographical errors, temporary unavailability for technical reasons, or third-party site content. Nothing herein limits the Seller's liability where prohibited by law, in particular Consumers' legal guarantee and right of withdrawal.

17. Force majeure

Neither party is liable for failure caused by force majeure or fortuitous events under the Civil Code (natural disasters, fires, wars, large-scale cyber-attacks, epidemics, authority restrictions, strikes, etc.). The affected party notifies the other within a reasonable time; if it persists beyond 15 days, either party may terminate the contract.

We process data under GDPR (Regulation (EU) 2016/679), Law 190/2018 and Law 506/2004. Details in the Privacy Policy and Cookie Policy.

19. Commercial communications (Newsletter)

By subscribing you consent to receive commercial communications by e-mail under Law 506/2004 and GDPR. You may withdraw consent at any time, free of charge, via the unsubscribe link in each message or at comenzi@aafit.ro. Data is not sold to third parties for marketing.

20. Changes to the Terms

We may amend these Terms at any time. The version applicable to an order is the one published when the order is placed. Please review this page periodically.

21. Governing law and jurisdiction

These Terms and the contracts concluded are governed by Romanian law. Disputes are settled amicably; failing that, they are submitted to the competent Romanian courts. Consumers benefit from the jurisdiction rules provided in their favour.

22. Dispute resolution (ANPC and ADR)

Please contact us first at comenzi@aafit.ro; we reply within 30 days. You may also contact the National Authority for Consumer Protection (ANPC) – anpc.ro. Under GO 38/2015 you may use Alternative Dispute Resolution (ADR) via ANPC's ADR structure – reclamatiisal.anpc.ro. This is out-of-court and does not affect your right to go to court.

23. Final provisions

If any provision is void, the rest remain valid. The Seller's failure to exercise a right is not a waiver. These Terms, together with the policies above, constitute the entire agreement regarding use of the Site.
